A man is suing (http://news.bbc.co.uk/2/hi/technology/4673584.stm) Apple (http://www.apple.com) because the iPod can cause loss of hearing and Apple (http://www.apple.com) does not warn iPod users of this properly.

He can't sue unless he actually lost his hearing though. In which case, it's actually a good products liability case. Good meaning that he has a legitimate chance to win. It's no different than a guy suing for sticking his hand in the running lawn mower. There were no warnings on the lawn mower saying keep your hands out of the blades, and that is a reasonably forseeable event. (That guy actually won his case against the lawn mower manufacturer.) The law does reward morons sometimes. Hooray! Learning products liability is finally paying off! haha

I hate Apple and the iPod but I wouldn't go as far as filing a law suit. That's pretty ridiculous. You can go deaf from being in your car and listening to your stereo system too loud. I don't see how this is a legit case.

I would have loved my iPod if it wasn't so inefficient. It broke so many times. I sent it in and they sent me a new one back. It broke like a week later after one use but they won't fix it because its been over a year since my original purchase.

Yeah.. I totally feel you on that.. Fortunately I've never had any problems with any of my iPods (I've had numerous just because I wanted more space/newer models over the year..) Although, I have a few friends who have had trouble with their iPods and it sucks because it's hard for me to relate since I've never had the problem.. but like any other electronics, sometimes they have problems and need to be fixed or replaced.. by the way.. all iPods come with a one year international warranty and my friends have all gotten theirs replaced/fixed since the problems.. I feel bad that you had a sub-par experience with your iPod..

Each iPod does carry the warning that "permanent hearing loss may occur if earphones or headphones are used at high volume".

I've heard about this... well, not [i]heard/[i] because I'm deaf now from listening to my ipod so much, but I read an article in Wired magazine about the damage an ipod can do and it gets me worried. The article says that it is only safe to listen to the ipod for a half hour a day at a medium level.
After going to so many concerts, I've been getting worried about my hearing a little bit, though it is fine for now. Might want it later in life though.

actually, this is the stupid thing:

the guy is trying to sue apple for not warning about the volume. Apple DOES however have a disclaimer thing saying 'dont listen to your loud music as it can damage your hearing kind of thing'. But! the guy then changed his reason for sueing saying that apple doesnt specify what 'loud music' is.
he's gunna lose the case miserably for having a huge lack of common sense.

F this guy and his lawyer. I figured this law suit would happen eventually. The sad part is Apple will most likely settle out of court, and this pathetic excuse for a man won't have to work a day the rest of his life.
