I don't think they can, unless they have BMI rights.
I don't know if it was posted here, but apparently Apple's BMI contract is running out soon, and Microsoft may take over, ditch MTV with it's new services, and run something like iTunes.

Sounds about right. A music service is what everyone's doing these days.

Personally, I would never use it. I have never paid for a music download and I never will. I only buy music in physical form.
