Tony Lovato (ex-singer of Mest) has a new band named Permanent Holiday and he's being hassled by another band named Permanent Holiday to change the name. Check below to see what Tony's opposition had to say about the issue.
Note: Keep in mind, this is only one side of the story. Also, don't always believe everything you read when it comes to "direct" quotes.
Tony Lovato stole our name "Permanent Holiday" and we plan on fighting for it by any means neccesary. We asked him nicely to change it to which his reply was "nothing to get all bent about" and "you should be stoked I'm sure there are alot of kids comin over to your site simply based on the fact they think im in the band.." followed by "we'll be on tour with fallout boy in a few months and then GC so um after that i think the kids will know he difference between bands. late"
This name has been ours for quite some time and we're not about to just give it up. Say what you want about us say what you want about Tony but this name honestly means more to us than anyone could ever understand. We've grown up in this band together and become a family under this name. Losing it would leave us with a feeling we can't begin to explain. We're not about to just let it go without a fight.

Who cares, there were two LFOs as well and the smaller one never got bent out of shape when the other one got big.
There can be room for two bands with the same name in this world.

Haha, my band was once called Skipjack and a shitty band from San Diego forced us to change our name, even wanted a lawyer to force us ... after we did, they never recorded anything again and disbanded ... I still hate them so bad for that ...

Yes, because it wouldn't be confusing as hell if both got big.
If you copyright a name, you OWN it, it is YOURS, and you have the right to it so this band getting upset is completely justified.
If popularity determined what was morally correct or incorrect this world would be extremely disoriented.

In reality two bands CAN exist with the same name as long as they are regional or w/e and dont interfere with each others fan base (i.e. the fans getting confused on which band is which). This certainly isnt the case here because lots of people remember MEST and maybe will give Tony Lovato's new band a chance.
Did the other band copyright the name legally? I know that if you use it first, you techincally have ownership of the name. But if they are just using it and didnt really LEGALLY copyright it will not stand up in court AT ALL. Rarely ever will.

I met tony 7 years ago in NYC before a show. I thought him an jeremiah were the nicest guys. Maybe they changed, but I hung with them for an hour and they just like to goof off a lot, but they never once were jerks or dicks to anyone around them while I was there.
The original Permanent Holiday are from my area in NH, they're nice guys... They're pretty good friends with Monty Are I too.

thats what I meant, TM. the law is complicated, but asking for one is not. its like buying a domain name on the net, not to hard, but maybe 1/100 local bands is smart enough to do it.
hey guys, Permanent Holiday NH we honestly didn't want this to get to this....we just really wrote to tony and he responded how it was quoted earlier...honestly we jsut want to keep our name and we will even go as far as supporting Tony in all his future plans...but we have a lot of stuff in the works as far as our band goes and a name change will hinder a lot of it...please just understand that we don't want this to turn into one side vs. the other.... honestly tho thank you to everyone who has showed a passion for this...take care

Tony and his girlfriend (this was a couple of years ago so I don't know if they're still together or what) represent the largest gap in attractiveness between two people who socially interact on a regular level...amazing the power of being in a crappy pup-punk band

yea we have looked into and contacted lawyers...band names are complicated we found out that as long as we have our cd we really have nothing to worry about. we just wanted it to be between us and tony...thanks for all the help though! take it easy

If the band from New Hampshire didn't trademark their name, then technically there is nothing that can be done and anyone is free to use it. However, all of you that keep calling Tony a douche and so on, maybe you should shut the fuck up. Yeah, sure he has his moments where he can be an asshole, but you don't know him personally so shut the fuck up and find someone else to insult, it's not like it's fucking hard, most of the kids on here spend more time insulting people then anything else. Try getting a hobby that doesn't involve calling people douchebags on a website.
I can't wait to hear Tony's new stuff, I was a fan of Mest for a long time, and I'll probably be a fan of this.

It's can't be THAT hard to come up with an original band name. Who cares how big or unknown one of the bands is. If one band had the name first, it's theirs, especially if it's copyrighted. When I first saw the name I was like "What a shitty name for a band." I'm sure Tony can come up with something better than that.

If they got a trademark on the name, which i hope they did considering it means "so much" to them, then they should be able to keep it, and sue tony for stealing it without their permission. if they didnt copyright, and tony did -- then its his. thats how the legal system works and ignorance is no excuse, either they trademark the name, or it's Tony's.
im pretty sure permanent holiday have been around for about 5 years and are from New Hampshire, they're all really nice guys and this really does suck.

Well...actually you can't copyright a name...you have to trademark it which is entirely different from a copyright and a much more painstakingly long and expensive process. You can copyright CDs under that band name which would give you at least a time line as to how long the older group has been using the name before the newer group used the name, etc. Unfortunately, in law only one thing counts: paperwork. If that band has any questions they should check out www.aptrademark.com (http://www.aptrademark.com) its a company that searches and helps to solidify the trademark legally.
