TM means it's a trademark & the R means it's a registered trademark. It's the same way with songs. Once you write something, it's copyrighted. It's just not registered unitl you file it with the copyright office.

Basically, they just have to prove they had the name first. That shouldn't be too hard since Tony already acknowledged it. If I were them, I'd take legal action just to make him look even more like a horse's ass.
