So last thursday night after senior ball there was this huge party, blah blah...me and 2 other friends i picked up where heading towards the party,we parked the car a good walk away from the house, but one of my friends had brought like 3 bags (girls can never bring just one bag) so me and the other friend each grabbed a bag and started to walk towards the party. la policia pulls up behind us, asks questions...we were kinda sketchy only because it was 1230 at night, but anyways...

he gets annoyed with us since we wouldnt tell him where we were going and where the party was so he searched us, it just so happened the bag i was carrying had my friends alcohol in it, the only alochol on us....i took the blame for her, being the amazing friend i am :dry:


so i am being charged for transp/carrying alcohol as a minor

i go to court monday, whats the worst that could happen?

i'm thinking worst come to worst i go on probation...
but thats a bit of a stretch im thinking either a fine, community service, or a few AA meetings...what do you guys think?

you have to go to court because of you were carrying alcohol? that is complete bs, by the way. why don't they just give you a ticket instead of wasting gov't resources and taking you to court?

I say, next time, transport your vodka in a water bottle/mixed with coke or something. And the same goes for other drinks

my friends and i usually roll it up at the bottom of a sleeping bag and walk carefully with it.

the water bottle things works too.

Yeah, this story is kind of sketchy. I don't get why you let them look in your bags.

I hope you werent stupid enought to consent to that search.... true...if you don't smell of alcohol or look drunk, you walk away.

My experience with the police is always this....

Officer: What's in your bag?
Me: Am I under arrest?
Officer: No...(blah blah)
Me: well then, I'll be going

Once the officer says you aren't under arrest, walk away, they have no reason to search or ask further questions. Also, it gives you a case for harrassment if they would try to get you with something. I've only had encounters with cops twice, and as soon as you ask that question, they normally move on

the cops might try and say that since you wouldn't tell him where you were going and that since it was the night of senior ball, which sounds like a pretty big social event, that they had probable cause to search you as you were suspicious. While I don't agree with that claim, you should know that that's going to be their answer if you try to say they searched you illegally.

unless you let them search you, then it doesn't really matter.

worst case, they'll probably give you a fine, especially since they didn't arrest you that night. Where I live, they can arrest you for doing this, but they generally don't. In MO, they also make you go to a class for one saturday where you learn about the dangers of alcoholism but I don't know how many other states do that.

I shouldve been more specific...It was a SPORTS BAG that the alcohol was in wrapped up in the girls sleeping bag., and i was arrested...however i do live in a small town, and a friend of mine who is a junior police officer just informed me, they are going to drop the charges and told me what i did was wrong and send me on my way.

this is how the event went..

-senior ball
-leave senior ball
-pick up friend a (no bags)
-picked up friend b (3 bags)
-parked my car a block away from the party due to cars
-friend a and i agreed to help friend b with her bags
-each grabbed a bag
-walked towards party
-officer stops us at 1230 am
-asks where we were going
-then asks each of us to empty out our pockets/bags
-not knowing i opened up friend b's bag i was carrying only to find out i had her alcohol
-officer then arrests me, brings me in
- after unhandcuffing me at the station reads me my maranda rights (20 mins after being arrested? a bit weird)
-picture/finger prints
-bailed
-court date monday

so...they're dropping the charges and nothing I'm about to say matters?

I would tell you that the fact that they didn't read you your rights right then could have definitely helped you, especially since you could claim you didn't know them as you allowed the search.

it's cool that they're dropping the charges. that's what I thought would happen, except you got arrested which kinda confuses me.

This is a technicality that can get you out of trouble completely. Tell your lawyer

wait wait wait. why would you let him in your bag? If there was no reason to believe that you were breaking any laws, you could have just been on your merry way.

They always give out appearance tickets to underage possession of alcohol, you'll have to pay a fine, but that's about it.
