well, they are pretty much the same thing. it depends on the state, but the only difference is that DWI implies he was over the legal limit of alcohol and DUI could be any kind of drugs, alcohol, etc.
edit: here's the north carolina law. "For purposes of the North Carolina per se laws, the primary issue relates to blood or breath alcohol levels of .08% or higher."

it also said he made an illegal u-turn to avoid a checkpoint. he knew actually what he did was wrong. a very stupid decision on his part. i dont see how anyone can defend him on this issue. oh well im sure he will learn for this mistake

That's a pretty stupid statement. Driving drunk puts the lives of others in danger. Not wearing a helmet simply puts your life in danger. HUGE difference. Ben was an idiot for not wearing his helmet, but he likely was going to be seriously injured either way. I have absolutely NO sympathy for someone who drives after drinking and hurts his/herself. If you know anyone who's been paralyzed/killed/etc. by a drunk driver I bet you wouldn't either. (I personally don't)
And Tate, haven't you seen the ad? Buzzed driving is drunk driving. :p

A .11 is like being up for 20 hours and driving. According to google it's like 3.5 beers.
Normally, this is a non-story, but since it's an athelete people don't like, all the "spoiled rich kids" complaints come out. Of course, not saying he's not a spoiled rich kid - but I don't see how getting caught driving with 0.11, pulling an illegal maneuver on the road, getting caught, publically apologizing, and serving the sentence in any way indicates that he's a "spoiled rich frat boy" or whatever.
Unless I missed the part where he's kicking and screaming the whole way to jail, he mouthed off to the cops, or kicked a reporter, or whatever.

well...the reality is you aren't alone in that...it's just a safe level of drink/drive. If you black out your night/are swerving all over the road (or trying to avoid DUI chechkpoints), you are probably too drunk and shouldn't have driven.

Half the league basically smokes pot (most of them gathering in the Portland Trailblazer Organization) so this is only a minor problem and I don't see it touching his draft stock.

I only had one bad one. Of the times I have done it, which really hasn't been that often, I would drink lightly, then wait around a while before I left. Only once I drank a ton, I tried to wait around, and I was told I was too drunk, and I was like "nah.. I'm only going like.. 8 blocks" since I lived like just over half a mile away. I was driving, and I realized I was far drunker than I thought I was, and was extra careful. In the morning, I only had one picture of the drive home in my mind, so I was like "hmm.. I'll listen to them next time."

Your driving abilities aren't affected too greatly with a bac of 0.11. He was just in the wrong place at the wrong time. Not too big a deal.

well, it depends what end of the .11 it was. If his BAC was .2 or so earlier in the night (I'd assume as much, since they mentioned the strong scent of alcohol), then mentally you are still fairly impaired, ususally by being tired still. I mean, the lack of judgement that comes with trying to U-turn out of a DUI checkpoint shows he was impaired in some way.

Bingo....but, media wise, bad year.
I'm still incredibly shocked that Duke didn't take a harder line stance in this...like punish them for the party, but assume their innocence elsewise, especially at a "law" college. THeir administration took the easy way out, and it hurt their team and the players greatly this year, and in the future (lots of lost scholarship athletes). Plus, they could ahve been natioanl champs, they were good enough to beat UVA
