if anything this puts the officers in more danger. here in texas, just about everyone has a gun, and busting into someone's house is an easy way to catch a bullet.

what do you guys think?

I need to read the actual decision before I say something. It depends on if they're going to use this case to go after the exclusionary rule or not.

I mean, I still disagree with it since cops should knock for common courtesy, but if they're not using the case as a precedent to go after the exlusionary rule, it stays a matter of common courtesy and not a full blown civil rights violation.

Here, in Texas, I would say it is not really a question of "common courtesy," but one of safety for both police officers as well as civilians. Someone comes into your home here, and residents shoot to kill with impunity.

I never really thought of it as a safety issue, but now I realize that it seems like a mess all around. I mean, if the cops bust in and get shot at, they're going to shoot back obviously.

Could this decision justify shooting a police officer in self defense? I could easily see that argument being made, especially if the officer is undercover.

i dont understand where the safety issue for the cops getting shot at by bursting in comes from? If you're going to shoot a cop when they burst in what makes it any less probable that you would shoot at them when they knock and announce that the police are there with a warrant?

thats what i was thinking, if the cops knock that gives the person inside time to load a gun and become aware

listen...er... read closely.
Here, in the state of Texas, many folks live with loaded guns inside their houses and apartments. If a police officer were to come into one of these residents homes unanounced, because that what we are talking about here, the resident can (and most likely will) shoot at anyone who might walk through the door. How is that not a safety issue for the police? And this could yield very, very important consequences if an officer is shot and killed by a resident who thought they were being burgled (whether or not that is truly the case or just the person's defence). I am not arguing that the officers have to give the resident time to "load and shoot," but as a safety precaution that should save tax dollars (for the inevitable trials) and lives.

someone might mistake the unannounced person barging through their door for a burglar and shoot to protect their property/family.

and in real life, i'm sure the courts aren't gonna care if you were surprised by a man breaking into your house with a firearm late at night. If you accidentally shoot a cop, they're still going to put you away for a long time.
