View Full Version : Guilty Until Proven Innocent?

A new article was recently published (http://torrentfreak.com/ip-harvesting-filesharers-guilty-until-proven-innocent/) on the behavior of fake RIAA and MPAA trackers which says that the organizations have "no proof that you actually tried to share infringing content. Even worse, it is extremely easy for someone to make it look like you shared an infringing file, even if you’ve never used a filesharing application."

Well duh, I mean wasn't our country founded on principles like "guilty until proven innocent"? It's just common sense, really.

yeah, i mean this makes sense. i do not think it's right, but the riaa is just trying to make examples out of people, even if they are innocent. it's a sad state of affairs, but this is what it's come to.

Its is me or should they concentrate on stopping albums from leaking rather then punishing downloaders.

Isnt that unconstitutional? I can wait til they go after a blind deaf guy .... and say that he downloaded music illegally. i will laugh at the RIAA's demise.

i dont agree with the RIAA, but at least they're trying to stop people from stealing music. I personally want to see record labels and the whole music industry keep going and do well. Why should a label sign a band if kids are just going to download their music? I feel bad for the people that are being made examples, but something extreme has to be done to get people to understand that downloading music is not legal.

That would be hilarious, but I don't think a blind/deaf guy would be on the computer in the first place.

Then they should lower cd prices, focus on stopping cds from leaking, and put more bonus content that goes with the cd ie. more artwork, dvds, lyrics, and all that jazz.

Does anyone remember the Blink self titled cd where Mark and Tom totally described out what all of the lyrics meant, and how they came up with the song, and everything. More bands should be encouraged to do that.

In my opinion, they could do alot more to encourage kids to buy cds. Instead of just sitting there bitching about it and suing people

yeah i completley agree. They should try to make cd's by smaller bands widely available too.

So you want the labels to give you more and pay less for it? Its rare that I buy a CD for more $10-12. How is a CD not worth that much? People spend more then $10 to go to a movie at the theater and how long does that last? An hour and half? A CD can last a lifetime. Tell me something else you can buy for $10 that you can appreciate for a lifetime! I do agree that giving additional content with the album such as videos or DVDs is going to help sell the album, but to sell it for less than $10 just isn't reasonable or even financially possible.

This is definitely a good point. I mean, a 13 year old may desperately want a cd by their favorite band but can't afford the $20 so they download it. Then once you get an actual job and have bills you'll want to buy the cd but then may have second thoughts because you need your money for car insurance or some bullshit bill.

Just because I feel the need to support the bands I really like, I'll buy the cd in most cases. But knowing that its available in other ways that don't involve your wallet makes it very tempting for a lot of people. Bonus content would be a good idea, definitely, as long as its first pressing and not some super special third release of the same cd that's been out for two years. And that Blink cd was the shit by the way.

It should be a well known fact that the majority of cases the RIAA brings to court have huge holes in them. You can most likely get the case thrown out if you stay in long enough to drive home some 4th Amendment isssues. The problem is the RIAA comes up with ridiculous lawsuits and then tries to settle out of court so that they can guarantee themselves some money off of each defendant. I would love to defend their cause, but they give me absolutely no reason to do so.

I don't think that would stop them. They've gone after dead people and won the cases.

BTW, I think this article is somewhat flawed. It sucks that anyone can be put on this list, but to my knowledge, a torrent would not have a tracker like this unless someone put it on there willingly, meaning that you'd have to conciously download the torrent containing this tracker in order to get in trouble. Am I wrong?

If you enjoy an album and won't spend $10 on it, then go fuck yourselves.

Sure, it's nice downloading all this music for free, but it's not helping the artist. Going to shows, buying shirts, and all that is good, but if you like a CD, buy it.

CD sales matter.

I couldnt agree more!!

When people say "Support Music", that just mean that you should listen to it, the key word is SUPPORT.
Ill admit that used to download music, that was before I became a music business major and there were not a lot of ways to discover new music. Today there are SOOO many ways to discover music, Myspace, Purevolume, Last.fm, ect, ect... There really is no logical reason to illegally download music anymore.

They are like $17 sometimes; try to buy them when they are lower than that. If you see a band on tour, chances are they're selling their disc for just $10.

Hell, one of my favorite albums of 2006 is like $7 on iTunes.. no reason not to buy it...

Wow, I'm appalled. There's more things to worry about in life than people downloading music. People are dying in third world countries while greedy douchebags are trying to sue people for downloading music. And I'm typing a response on a message board. What a world.

Did you read the article? People can spoof your IP address through "peer exchange" or just by having you click on a random link.

Not to mention that intent to infringe copyright is NOT the same as actually doing it.

And no, they didn't win the case against the dead woman. They dropped it.
