Obscenity has always been the subjective card.

Who is the judge that said "I don't what obscene is, but I'll know it when I see it."

too bad he couldn't have appealed. he could have proved the artistic merit of his work, or came up with some political undertones in it.

well, boiled angel was about what he felt were pertinent issues. he just depicted them in a very graphic way. the judge ruled that there was no redeeming value to his art, thus negating his appeal.

i'm surprised the CBLDF wasn't able to help him more. They're usually the go to guys in terms of censorship and art.

but couldn't he have appealed to a higher court? usually in these obscenity cases the original judge rules that there's no redeeming quality. i'm pretty sure that's what happened in the Dead Kennedys case.

i dont understand how he could have gotten in trouble by the government for that. bullshit.

i'm not really sure. i just recently found out about this case; i need to spend more time looking in to it.

yeah i wasn't sure. i mean 2 live crew got into the same problem down in florida back in the early 90s (them being the first conviction for obscenity ever) and it got overturned by the appeals courts, so i'd think the same thing would happen in this case, but who knows? maybe there's something that makes "me so horny" inherently more artistic than his comics.
