View Full Version : Contesting Speeding Tickets

So tonight I got pulled over by a cop, and was given a ticket for going 80 in a 55mph construction zone. But I was caught speeding by my pace compared to the other car's pace. I certainly know I wasn't going 80, it was more of 67-73 area, and I wasn't in a construction zone, the speed limit was 60. When he pulled me over, we had just started to enter it upon which the speed limit was 55. I was more or less pulled over at the entrance of a construction zone.

This is my first ticket, should I fight this? What are my chances of actually getting the case dismissed?

I would consider getting a lawyer if that's possible, it sounds like the cop was clearly not correct if what you're saying is true. Fighting against a cop without a lawyer is pointless, I tried that and the judge basically looked at me (as an 18 year old kid, no less) and took the cop's word over mine, even though there was no proof whatsoever. Fuck tha police.

correct. my cousin is a state trooper. he says he doesn't go if it's raining, or a really nice day out. he also won't go if he's tired. he really only goes if he's that bored haha.

i think getting a lawyer would just end up costing you more.

Go on Judge Judy. Then no lawyer is needed.

Judge Judy is for civil cases.

did you admit to speeding when he pulled you over? no matter what speed you were going be it 80, 180 or 56, if you admitted to him that you were speeding then there is no point in contesting it as you are GUILTY

it will be cheaper in the end to pay the ticket, trust me

Contesting anything at all is a pain in the ass. Just suck it up and show up to court, you might get lucky and have the cop not show (he didn't for my sister).

Good luck.

You were still going 63-73 in a 55, which is (guess what) still speeding. Pay the ticket and quit bitching.

Too late now, but you should have asked to see the radar gun readout.

Yeah.

It was in a 60mph and not in a construction zone. He pulled me over at the entrance of the construction zone. I would not fight it if he would not have put the construction zone and overstated my speed on the ticket. And he didn't get me with a radar gun. He said he got my speed by seeing my pace(or speed) compared with the car besides me. There was no radar gun involved. It's even written on the ticket.

true, and in utah if they don't show you, you're supposed to ask for the officer's name and badge number so you can file a complaint. then they'll usually just tell you to drive slower and have a good night.

Did he radar the other car? Does he have a clocked speed on anyone? If not, there's no proof at all you were speeding, since the other car could have been doing 45.

Not that I know of, although I'm not sure. All he told me was he "clocked" me in at 80mph by how fast I was going compared to the other car. All the ticket mentions is my speed was determined by pace.

Sounds like bullshit to me. He has to have harder evidence than simply "he was going slower than that guy." Like I said, what if "that guy" was going well below the limit? I would imagine it would get thrown out based on lack of evidence, but I'm not sure how the laws work there.

if you get a decent lawyer, he'll make the cop sound incompetent and, whilst you probably won't get off completely (though, with a good lawyer, it could happen), the fine is likely to be reduced considerably.

Go to court, find a lawyer and get the fine reduced or charges dropped.

Ugh I got a speeding ticket last weekend on my way down to school. Cop pulls me over, goes, "hey, I got you going 85 on the radar...." and I'm like ah fuck. He gives me a ticket for 75 in a 65 zone though... so hopefully the fine isn't too ridiculous. I'd like to contest it by going to the court date but I can't cause it's in Solvang which is like 40 minutes away. Arlksdf;lksjflkj.

Radar detectors ftw. Ohio is so anal about speed. One ticket and you're under 18, and you loose your license for six months. I go 5-10 over at the most, but I have a radar detector for extra security. Pay the $300 for the best detector on the market, rather than $400-500 down the drain on a ticket.

an old friend, whose still friendly with my best friend was driving and my friend goes to her "watch your speed limit there's a cop over there" and she replies with "they can't pull me over this is Howell, and I live in Brick" I can't hahaha, but yeah that kind of sucks. You can't really fight a speeding ticket just pray that they judge lowers the speed limit defense. Or buy down the points and pay off the ticket.
