wasn't there a big court case about something like this a while ago? for some reason it seems familiar, but i can't think of the specifics or how it was decided. or maybe i'm just delusional.
anyways, let the kid sit if he wants to. "patriotism" shouldn't be forced upon people.

"Patriotism is supporting your country all the time, and your government when it deserves it." -Mark Twain
The court case was about the words "under God" in the pledge.

I've said it once, and I'll say it again, a pledge is something you do once, numerous times is just indocrtination.

I don't remeber specifics, but some councilman (I think here in CO) refused to stand during the pledge at the begining of meetings. Is that what you were thinking of?
