Hi There. I am Carlos Moreno AKA Class Action Records. Around 3:30pm Saturday, I stopped at a red light and 3 seconds after I made a full stop a small truck going about 50 to 60 mph was trying to change lanes and hit the back right of my car and pushed me into the chevy truck in front of me. My car went under the truck and jammed the back right wheel of my car. These kind of things just make being a label tougher but I am happy to be able to walk and still talk without any bloodshed. In my own words, " No blood, No foul."
Just last week I had to use my label money to install a new alternator in my car basically a $350 value and no it's useless. He's a nice guy, I've talked to him multiple times, tried getting some bands on the comp. (and if they sent their stuff in they would've) I still need to buy one of these. I have $0 though...

For the record....
I am not trying to publicize for peoples money. This is just a demonstration of how hard it is to be a D-I-Y label. I've received a phone call saying that I need to get a job.. and the truth is is that I was "let go" due to slow business. BUT, this christmas will be a little better. We'll have to see.

Sometimes car insurance doesnt cover anything. Take for example I got into an accident in august '04 when a truck tboned my car going about 50 mph. They're suing me for 50,000 dollars and my insurance is only 20/20 so they only cover 10,000 of that. The other 40,000 all comes out of my pocket. Although, we did file a suit against them as well since it wasn't my fault in the first place and their claim is untrue, also including people in it that weren't even involved in the accident ( the husband has a suit in there for lack of sex, lmao ) .. then again, after katrina I dont think I have a lawsuit anymore.

I was also recently in an accident. I was hit by an uninsured motorist (which apparently Carlos is too or he would not have had to pay for his car with his "label money"). Luckily I have uninsured motorists covereage and EVERYTHING was paid for.
So here is a hot tip to all of these people as of late saying please donate money to us because (a) our gear got stolen, (b) I was sick and needed to go to the doctor, or (b) i was in an accident....
Get some insurance.

Bad insurance may not cover everything...good insurance covers everything.

First of all, it should be the person who hit you who's insurance company is paying for this. Unless that person was uninsured in which case your uninsured motorists inusrance will cover the damage to your car. Under no circumstance should you/your insurance be paying for the truck in front of you. Either the insurance company of the driver that hit you should be paying or the insurance company for the guy in front of you should be paying. Know what I mean?
I think you should consult your attorney, because it sounds like you are getting raped in the ass on this deal.

I am an insurance claims adjuster and I handle auto accidents. Here's the scoop on what really happens, which is the same as what most of you have already said.
1. If someone else hits you and it's their fault, their ins. will pay for you. If they are uninsured, then some states have u/m coverage, or if not you can use your own collision coverage and then your insurance company will get the money back from whoever hit you. They have lots of tools they can use to do this. If you have no collision or umpd and the other driver is u/m, then you're basically screwed, but usually this means your car is a worthless piece of crap and that's why you're not protecting it.
2. If you're upside down on a loan or buy a brand new car off the lot, it's always good to have GAP.
3. If repair cost gets to about 75% of the value of the car, it is a total loss and they will give you market value for it. It is usually done with NADA book, not kelly blue book. And no your 1990 Toyota Corolla with 250,000 miles on it is not worth $10,000, even though it gets great gas mileage and was supposed to last you through college.
4. Hiring an attorney is never a good idea because they can't increase your settlement, they only take part of it. I usually actually give people that don't hire them more because they are usually more honest with me. Claims adjusters know the law and have a lot more than you think to lose if they don't follow it, so hiring an attorney won't make the situation any different.
Hopefully that gives people a glimpse of what's going on "behind the scenes."

My point was not to get an attorney to get more from the insurance company...my point was he should consult his attorney (he runs a record company so I'm assuming he has at least one) because it sounds as though HE is paying for the dude in the front vehicle...which he should not be. My guess he is wrong about this, but if he indeed is then either (a) the accident was his fault and he's not telling us that or (b) he's getting screwed by someone. hence the need for an attorney.

I play in a band, and I have, on numerous occasions, tried to procure insurance for our trailer/equipment because we have seen other bands' gear getting stolen. However, I have asked three different insurance companies, and they won't sell me insurance. The automobile insurance says it should be covered under homeowner's, and homeowner's says that when I'm out on the road, they won't cover it. It's an incredibly difficult situation. I'm sure that you'll have a witty comeback for me, though. Thanks.

your insurance company sucks. i have renters insurance that covers up to $25,000 worth of stolen property, whether it's in my apartment or not. it costs $15 a month.

Yup. My bands gear (while on the road) is all covered by my homeowners insurance. Trust me, if college quarterbacks can insure their arms, you can insure you bands equipment.
