I really think they'll lose this one. If they're calling it "their own," EMI could then play the card and say "well if you're saying this is yours, it says a heck of a lot like ours, which was recorded before yours and which we have a copyright for."

It is certainly worth trying considering how much money could be made. But at the same time I can pretty much guarantee they lose this one, and the court will close the loophole.
