Yeah, I think they asked and Rivers wouldn't let him use it on the album. So they just wrote a similar guitar part.

As far as I know, this is not the case. I believe it's illegal to use copyrighted work w/o permission, regardless if the aim of infringement is to make money.

Correct. Non-commercial use would just be a factor to consider if Kanye asserts a fair use defense. Though it seems he's getting sued for selling it on Amazon, not for sampling it on a mixtape.
