From the ArticleJudge James Moran held that Victory does not hold exclusive rights for the band's recording services. Simply put, it means the band can record for any label.

Howard Benson makes it a habit of putting bands in his top 24 on myspace that he is either currently working with or will be working with soon. Hawthorne Heights was recently added to the list fueling speculation that the band will be recording with the prolific producer.
