MTV.com has an article on the Hawthorne Heights split from Victory, and in the article, it talks a little about Victory's response to the lawsuit. Take from the article:
MessageBrummel did not return a request for comment, but Robert Meloni, litigation counsel for Victory Records, said the lawsuit has no merit whatsoever.

"Victory Records fully expects Hawthorne Heights to honor their commitment to deliver two additional studio albums to Victory pursuant to their recording artist agreement with Victory," Meloni added

Hawthorne Heights is leaving Victory Records and have sued them. Here's why, taken from their Myspace blog:
MessageDue to recent events we have decided to leave Victory Records. Our departure is anything but amicable. We have decided to leave Victory, in part due to the actions of the man who sits at the head of the label, Tony Brummel. Tony Brummel is a man that cares more about his ego and bank account than the bands themselves.

Many of you are familiar with the greed driven letters sent out by Mr. Brummel: his manifesto calling rock supporters to arms and virtual declaration of war on hip-hop and Ne-Yo done under the guise of a band message; as well as the street-team letter which...

I doubt that this will reach you but I figured I'd give it a shot.
As a fellow entrepreneur I find it quite strange how your "music" people have treated my company. I am not like the guys at the major record labels. I am a self-made entrepreneur. My counterparts are ultimately employees that do not have the flexibility or ability to operate with real creativity in an industry that requires such.

Below you can find a rant on Tony Brummel from Industry vet Bob Lefsetz.
RantTony Brummel has gone from hero to zero in my book.

Here was a guy trying to do it a different way. Signing acts the majors weren\'t interested in and marketing them without radio. We applaud that. But concomitant with a bit of success Mr. Brummel has come out of the hole from which he resides to reveal himself to be a paranoid megalomaniac who believes the rules don\'t apply to him.

I blame Bill Clinton. For lying about getting a hummer. Oh, he parsed the words pretty good, but if the President of the United States lies under oath, essentially saying the rules don\'t apply to him, what message does this...
