Gym Class Heroes were in a serious van accident early Thursday morning in southwestern New Mexico. They totaled their van and trailer, and most of their gear was unsalvageable. Travis, Matt, Disashi and Eric are all alright, just a little banged up. Seth was flown to a near by hospital, and got out of surgery late last night. He is in good spirits, and will hopefully be heading back to New York this weekend. A full statement from the band will be coming soon, but we just wanted to let you all know they have cancelled their shows this weekend in Arizona and California. Summer tour plans remain the same, and they look forward to seeing you all on Warped Tour.

Sony BMG has struck a deal with the plaintiffs in a class action lawsuit over copy-restriction software it used in music CDs, according to a settlement document filed at a New York court Wednesday.

The record label has agreed to compensate buyers of CDs that contained the XCP and MediaMax DRM programs and to provide software utilities to allow consumers to uninstall both types of software from their computer.

In the settlement filing, Sony states that it will immediately recall all XCP CDs and replace them with non-content-protected CDs. It has also agreed to offer incentives to U.S. customers to "ensure that XCP CDs are promptly removed from the market." Sony first released...

Below is a message from Carlos of Class Action Records:

Message From CarlosHi There. I am Carlos Moreno AKA Class Action Records. Around 3:30pm Saturday, I stopped at a red light and 3 seconds after I made a full stop a small truck going about 50 to 60 mph was trying to change lanes and hit the back right of my car and pushed me into the chevy truck in front of me. My car went under the truck and jammed the back right wheel of my car. These kind of things just make being a label tougher but I am happy to be able to walk and still talk without any bloodshed. In my own words, " No blood, No foul."

Just last week I had to use my label money to install a new alternator in my car...
